Our Pledge to You
At Nourish and Justice, LLC, we are committed to protecting your privacy and the confidentiality of your personal health information (“PHI”). We are required by federal law (Health Insurance Portability and Accountability Act of 1996 — HIPAA) and New York State law to maintain the privacy and security of your identifiable health information.
We value the trust you place in us and pledge to:
- Protect your PHI with strict safeguards and ethical standards.
- Use and disclose your PHI only as permitted or required by law.
- Provide you with access to your information and respect your rights regarding it.
- Notify you promptly if a breach occurs that may have compromised the privacy or security of your information.
How We May Use and Disclose Your Health Information
The following categories describe different ways Nourish and Justice, LLC may use and disclose your PHI. Not every possible use or disclosure is listed, but all the ways we may use or disclose your information fall within one of these categories.
1. For Treatment
We may use or share your PHI to provide, coordinate, or manage your care. This includes sharing information with other healthcare professionals (e.g., doctors, midwives, therapists) involved in your treatment.
2. For Payment
We may use and disclose PHI to bill and collect payment for services you receive. This may include sharing information with your insurance company or other entities responsible for payment.
3. For Health Care Operations
We may use your PHI for administrative, quality assurance, and business management purposes. Examples include reviewing practitioner performance, training staff, or improving our services.
4. Appointment Reminders and Communications
We may use your contact information to remind you of appointments or to provide information about treatment alternatives, wellness services, or other health-related benefits.
5. Research Purposes
With your written authorization, your de-identified PHI may be used for research or program evaluation purposes. Identifiable information will not be disclosed without your explicit consent.
6. Incidental Uses and Disclosures
Certain limited disclosures may occur incidentally, such as overheard conversations or misdirected mail. We take reasonable steps to minimize such occurrences and protect your privacy.
Special Situations Where We May Disclose Your PHI Without Consent
In certain circumstances, we are permitted or required by law to disclose PHI without your authorization:
1. As Required by Law
We will disclose information when required to do so by federal, state, or local law.
2. Court Orders and Legal Proceedings
We may disclose your PHI in response to a valid court or administrative order, subpoena, or other lawful process, consistent with New York State and federal law.
3. To Prevent a Serious Threat to Health or Safety
We may disclose information if we believe, in good faith, that it is necessary to prevent or lessen a serious and imminent threat to your health or safety or that of others.
4. Suspected Abuse or Neglect
We are mandated reporters under New York State law. We may disclose PHI to appropriate authorities if we reasonably believe that you, a child, an elderly person, or a vulnerable adult has been a victim of abuse, neglect, or domestic violence.
5. Public Health and Safety
We may disclose PHI for public health purposes, such as preventing disease, reporting births or deaths, or reporting reactions to medications.
6. Health Oversight Activities
We may disclose PHI to health oversight agencies for audits, inspections, or investigations as authorized by law.
7. Essential Government Functions
We may disclose PHI for specialized government functions such as national security, military, or protective services if required by law.
8. Lawsuits and Disputes
If you are involved in a lawsuit or legal dispute, we may disclose your PHI in response to a court or administrative order or, in some cases, a subpoena, discovery request, or other lawful process.
9. Psychotherapy Notes
Psychotherapy notes are given special protection under HIPAA. We will not disclose psychotherapy notes without your written authorization, except as required by law.
Your Rights Regarding Your Protected Health Information
You have the following rights regarding the PHI that we maintain about you:
1. Right to Inspect and Copy
You have the right to review and obtain a copy of your PHI, with limited exceptions. Requests must be made in writing. A reasonable fee may apply for copying or mailing.
2. Right to Request Amendment
If you believe your PHI is incorrect or incomplete, you may request an amendment. We may deny your request in certain circumstances, but you will be informed in writing of our decision.
3. Right to an Accounting of Disclosures
You may request a list (accounting) of disclosures of your PHI made by us during a specified period, excluding those for treatment, payment, and health care operations.
4. Right to Request Restrictions
You may request restrictions on how your PHI is used or disclosed. While we are not required to agree to every request, we will comply when legally possible.
5. Right to Confidential Communications
You may request that we contact you in a specific way (for example, only at home, by email, or by mail). We will accommodate reasonable requests.
6. Right to a Paper Copy of This Notice
You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
7. Right to File a Complaint
If you believe your privacy rights have been violated, you may file a complaint with:

You will not face retaliation for filing a complaint.
Changes to This Notice
We reserve the right to revise or update this Notice at any time. Any changes will apply to all PHI we maintain. The current Notice will always be available upon request and posted in our office and on our website.
