Unexpected Pregnancy Loss, Stillbirth & Bereavement Support

In the event of pregnancy loss (miscarriage, stillbirth), neonatal death, or other reproductive outcome that prevents the intended “live birth” portion of the support package, the following terms apply:

  1. Acknowledgement of Scope
    • The Client and Nourish and Justice, LLC acknowledge that full-spectrum care includes support for all reproductive outcomes, including loss, and that such outcomes may require a shift in the nature of services provided.
    • In such an event, the Client and Provider will collaborate to establish a modified support plan (the “Bereavement Support Plan”) to address emotional, informational, and memory-making needs.
  2. Refund / Credit / Continuation Policy
    • The deposit paid to secure the spot on the calendar remains non-refundable, as it compensates the Provider for reserving time, planning, and holding availability for the Client.
    • If the loss occurs prior to the active labor/birth support portion, the Provider will offer one of the following, at the discretion of the Client and subject to consultation:
      • Credit toward a future service package (e.g., postpartum care or future pregnancy/birth support) with Nourish and Justice, LLC, valid for 12 months.
      • Partial refund, defined as “50% of remaining balance”, acknowledging that some planning and meetings were already provided.
    • If the loss occurs after active labor/birth support has commenced, refunds will not be available for services already rendered. The Provider will instead continue to offer bereavement support as detailed in the Bereavement Support Plan.
  3. Bereavement Support Services
    • After the event of loss, the Provider will offer up to 3 follow-up sessions (virtual or in-person) within six months to support emotional processing, rituals/memory work, referrals to grief resources, and planning for next steps.
    • Additional consultations beyond those included in the plan may be offered at the standard hourly consultation rate.
  4. Client Choice & Boundaries
    • The Client has full choice to decline bereavement support if they prefer and may choose to transition to other grief professionals.
    • The Provider reserves the right to refer the Client to specialized grief/trauma counsellors, if the Client’s needs exceed the scope of doula or social worker services.
  5. Documentation & Acknowledgement
    • The Client acknowledges that they have been informed of the possibility of pregnancy loss and understand how the service agreement shifts in such a scenario.
    • The Provider will document any modifications to the original support package in writing (e-mail or amendment) that both parties sign to reflect the Bereavement Support Plan, credits/fees, and future scheduling.
  6. Service Provider Limitations
    • While Nourish and Justice, LLC commits to compassionate, trauma-informed support, the Provider is not liable for the occurrence of pregnancy loss, stillbirth, or neonatal death, nor for any emotional or medical outcomes resulting from the loss.
    • The original Limitation of Liability and Indemnification provisions in this Agreement remain fully applicable.
